OVERVIEW OF THE INCREDIBLE WORKPLACES™ ASSESSMENT AND CERTIFICATION PROGRAM

The Incredible Workplaces™ Certification Program serves as an organization’s initial step toward developing an exceptional workplace environment and provides the opportunity to receive official Incredible Workplaces™ Certification.

1. AGREEMENT TO TERMS

These Terms and Conditions ("Terms", "Agreement") constitute a legally binding agreement between you, whether personally or on behalf of an entity ("You", "Your", "Organization") and IWP Media and Consulting Private Limited ("Company", "We", "Us", "Our"), concerning your participation in the Incredible Workplaces™ Certification Program ("Program", "Service").

By submitting an application, making payment, or otherwise participating in the Program, you acknowledge that you have read, understood, and agree to be bound by all of these Terms and Conditions. 

 

IF YOU DO NOT AGREE TO ALL THE TERMS AND CONDITIONS OF THIS AGREEMENT, YOU MAY NOT PARTICIPATE IN THE PROGRAM.

 

2. PROGRAM OVERVIEW

The Incredible Workplaces™ Certification Program serves as an organization's initial step toward developing an exceptional workplace environment and provides the opportunity to receive official Incredible Workplaces™ Certification. The Program evaluates organizational culture, practices, and employee satisfaction through a comprehensive assessment process.

 

3. ELIGIBILITY AND AUTHORIZATION

 

3.1 Legal Authority

By accepting these Terms, you verify and warrant that:

  • You possess proper legal authority to act as your organization's representative in this Program

  • You are authorized to bind Your organization to these Terms and Conditions.

  • All information provided in your application is accurate and complete

  • You are at least 18 years of age and above.

3.2 Organizational Commitment

Your organization commits to:

  • Completing the assessment process in its entirety.

  • Adhering to all Program guidelines and deadlines.

  • Providing complete and accurate information throughout the assessment.

  • Ensuring employee participation without influence regarding survey responses.

 

4. ASSESSMENT PROCESS

 

4.1 Standard Assessment Steps

The assessment includes the following key components:

  1. Application Submission: Organizations apply for Incredible Workplaces™ certification

  2. PULSE Audit Form: Organizations complete the PULSE Audit Form covering ten questions based on the PULSE Framework (Deadline: 14 days from form delivery)

  3. Employee Survey: Required employee participation with minimum 70% response rate (Deadline: 14 days from survey launch)

  4. Domain Whitelisting: Organizations need to do the domain whitelisting (incredibleworkplaces.in) for the smoother delivery of email for the employee survey.

  5. Employee Survey Announcement: Organizations must inform employees using the CEO/CHRO communication provided by Incredible Workplaces™, completed one day before survey launch

  6. Evaluation: Analysis of PULSE Audit Form and survey data by the IWP review committee

  7. Feedback: Detailed strengths and improvement recommendations provided

  8. Certification: Incredible Workplaces™ certification awarded based on evaluation results

  9. Celebration: Certified organizations receive recognition and exclusive event invitations

  10. Annual Re-Evaluation: Yearly reassessment required to maintain certification status

 

4.2 Timeline Compliance

Failure to meet assessment timelines will result in process termination and application cancellation. Organizations must adhere to all specified deadlines without exception.

 

5. DATA PROTECTION AND CONFIDENTIALITY

5.1 Organizational Data Protection

  • Incredible Workplaces™ maintains the complete confidentiality of all organizational data

  • All organizational information will be securely stored and will not be transferred or sold to external parties

  • Company data and contact details will remain confidential except as specifically outlined in these Terms

 

5.2 Information Sharing

Organizational data and contact information will only be shared with:

  • Pre-authorized media partners who have formal written agreements with Incredible Workplaces™ for publishing certified organization lists

  • External parties with advance approval and solely for positive recognition purposes

  • Complete employee survey scores will only be released with organizational consent and for positive recognition purposes only

 

5.3 Data Retention and Destruction

Employee information and physical survey documents will be destroyed within 12 months after survey completion, after which no related information can be provided.

 

5.4 Process Verification

Incredible Workplaces™ maintains the right to contact survey respondents to verify process authenticity and response accuracy, limited to exceptional cases only.

 

6. CERTIFICATION DECISIONS AND PUBLICATION

6.1 Certification Authority

  • Incredible Workplaces™ holds final authority regarding all certification decisions

  • We reserve the right to grant, withhold, or revoke certification regardless of assessment outcomes, based on our validation process

  • Organizations must receive official written confirmation to claim certification status

  • Incredible Workplaces™ maintains discretion over accepting or rejecting assessment applications

 

6.2 Publication Rights

  • Your organization's name will only be made public on social media platforms and other channels if it successfully achieves Incredible Workplaces™ Certification

  • Incredible Workplaces™ may use Your organization's information for positive recognition across all media formats

  • Certified organizations will receive an official recognition stamp and logo with specific usage guidelines

 

6.3 Certification Revocation

Certification may be withdrawn due to:

  • Controversies or negative media coverage

  • Non-compliance with these Terms

  • Failure to maintain certification standards

  • Any conduct that compromises the integrity of the Program

 

7. PAYMENT TERMS

7.1 Payment Requirements

  • All payments must be made to "IWP Media and Consulting Private Limited"

  • Payment must be completed within 30 days of invoice issuance or 48 hours before survey initiation, whichever comes first

  • Organizations must cover any travel and logistics expenses for onsite activities

 

7.2 Fees and Charges

  • Assessment fees are as specified in the application or quote

  • Additional charges may apply for onsite activities, travel, and logistics

  • All fees are exclusive of applicable taxes unless otherwise stated

 

8. INTELLECTUAL PROPERTY RIGHTS

 

8.1 Proprietary Materials

  • All assessment materials and methodologies remain Incredible Workplaces™ intellectual property

  • Written permission is required for any use of our assessment materials or methodologies

  • The Incredible Workplaces™ name and logo are copyrighted and restricted from unauthorized use

 

8.2 Certification Materials

Certified organizations will receive:

  • Official recognition stamp and logo

  • Specific usage guidelines for certification materials

  • Rights to use certification status in accordance with provided guidelines

 

9. EMPLOYEE SURVEY INTEGRITY

 

9.1 Non-Influence Policy

Organizations must ensure employees remain free from influence regarding survey responses through any form of communication, including but not limited to:

  • Direct or indirect coaching on responses

  • Incentives tied to survey outcomes

  • Threats or pressure related to participation or responses

  • Access to survey questions before official launch

 

9.2 Survey Administration

  • Organizations must follow provided communication guidelines exactly

  • CEO/CHRO communication must be distributed as specified

  • Survey launch procedures must be followed precisely

 

10. COMPLIANCE AND VIOLATIONS

 

10.1 Withdrawal Fees

Non-compliance with these Terms results in a withdrawal fee of INR 25,000/- (plus applicable taxes), except for NGOs/Social Services Organizations.

 

10.2 Violation Reporting

Term violations will be reported to the organization's CEO, with Incredible Workplaces™ decisions being final and binding.

 

10.3 Consequences of Breach

Material breach of these Terms may result in:

  • Immediate termination from the Program

  • Revocation of any granted certification

  • Withdrawal fees as specified

  • Legal action for damages

11. UNCONDITIONAL SERVICE GUARANTEE

While our team has always prioritized excellent client service and high delivery standards, we formally offer an Unconditional Service Guarantee. This guarantee applies to service quality but remains independent of certification outcomes. The guarantee covers:

  • Timely delivery of assessment components

  • Professional conduct throughout the process

  • Quality of feedback and recommendations provided

 

12. LIMITATION OF LIABILITY

 

12.1 Liability Disclaimer

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, INCREDIBLE WORKPLACES™ AND ALL ASSOCIATED ENTITIES ARE RELEASED FROM CLAIMS OR LIABILITIES RELATED TO THE ASSESSMENT PROCESS, EXCEPT AS SPECIFICALLY OUTLINED IN THESE TERMS.

 

12.2 Damages Limitation

IN NO EVENT SHALL INCREDIBLE WORKPLACES™ BE LIABLE FOR:

  • Indirect, incidental, special, consequential, or punitive damages

  • Loss of profits, data, use, goodwill, or other intangible losses

  • Damages exceeding the amount paid by You for the Program

 

13. DISPUTE RESOLUTION

 

13.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of India, without regard to conflict of law principles.

 

13.2 Jurisdiction

Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts in Haryana,, India.

 

13.3 Arbitration

Before pursuing litigation, parties agree to attempt resolution through binding arbitration in accordance with the rules of the Indian Arbitration and Conciliation Act, 2015.

 

14. TERMINATION

 

14.1 Termination Rights

Either party may terminate participation in the Program:

  • Upon material breach of these Terms with 30 days written notice to cure

  • Immediately for fraud, misrepresentation, or willful misconduct

  • As otherwise provided in these Terms

 

14.2 Effect of Termination

Upon termination:

  • All rights and obligations under these Terms cease

  • Confidentiality obligations survive termination

  • Payment obligations for services rendered remain due

  • Certification rights, if any, are immediately revoked

 

15. MODIFICATIONS TO TERMS

15.1 Amendment Rights

Incredible Workplaces™ reserves the right to modify these Terms at any time. Modifications will be effective upon posting to our website or other notification method.

 

15.2 Continued Participation

Continued participation in the Program after modification constitutes acceptance of the revised Terms.

 

16. SEVERABILITY

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that these Terms will otherwise remain in full force and effect.

 

17. WAIVER

No waiver of any term or condition of this Agreement shall be deemed a further or continuing waiver of such term or condition or any other term or condition.

 

18. DIGITAL ACCEPTANCE

 

18.1 Electronic Agreement

This document is digitally binding without requiring a physical signature. Terms and conditions acceptance is confirmed through digital acknowledgment.

 

18.2 Confirmation of Accuracy

By proceeding with the Program, You confirm the accuracy of all provided information and Your agreement to these Terms.

20. ACKNOWLEDGMENT

BY PARTICIPATING IN THE INCREDIBLE WORKPLACES™ CERTIFICATION PROGRAM, YOU ACKNOWLEDGE THAT YOU HAVE READ AND UNDERSTOOD THESE TERMS AND CONDITIONS AND AGREE TO BE BOUND BY THEM.
